Canadian Justice failing... Again

 I really wanted to get back to the series of blogs I have been trying to write. I am very close to being done my next couple entries but shit just keeps popping up. Somethings just blow my mind and the current failure of the Canadian justice system (once again) is making me rant!

Again we see a tragic domestic situation, where a common law husband Kenneth Skelly, murders his common law wife. I am not even getting into that part of this story, but into Skelly father Joe. If you haven't heard the story Kenny murders his wife and takes her body to his dads house. I guess dad has a drinking problem and is drunk when son arrives. Son says "Hey dad, killed my wife what should we do?" Guess she has some distinct tattoos and they don't want her ID'd. So the brain trust decides, lets chop her up! What in the fuck is wrong with these people! Your kid comes to you with a body and you help chop it up??? For some context daddy was an ex butcher and he used an axe, boning knife and electric saw to cut off her head and arms, which he then placed in a burn barrel and burnt. Then casually tossed into a fucking recycling bin. Then he realizes he is too drunk to deal with the torso, so he sleeps it off until the next day, when he tarps her up takes her out to a remote area by Whitecourt and buries her in a shallow grave. 

She is reported missing, the police stop by daddies, he tells them she is a bad person and probably ran away. Now I am not sure what brings the police back a few days later for his phone, but they do come back and he caves. Eventually telling what happened and bringing the police to her remains.... What do you think he gets for this?? 12 months house arrest. Yup that's all, hack up a body and you can enjoy all the comforts of home as a punishment! So I had to go to Canlii and read the thought process that led us here. If you don't know Canlii is Canadian Legal information institute, you can read the Judges take on a case there....

Before we get into that though I am going to get a bit dark. Do you know who Roy DeMeo was? 70s and early 80s gangster that became infamous as a stone cold killer, leading a crew that was describe more like serial killers than gangsters. The perfected the "Gemini Method" where they murdered someone and then dismembered the body. Something they always did was hang a body upside and slit the throat, letting it drain into a tub for an hour to get rid of all the blood before going to work. Do you think these two clowns were smart enough to do that?? Maybe or more likely in a garage in the middle of the night they chopped someone up like a mother fucking horror movie. So when you hear the "he was a good guy" statements keep in mind this ghoul was chopping up a person. In reality most people can't wrap their brains around it, it is so horrifying. That why we see it in movies and it turns our stomachs. Oh and just a cherry the person being destroyed is his grandsons mother.

First we hear there is no minimum sentence for causing indignity to a body. It actually makes sense, sort of. Most times this happens, it isn't a horror movie it is someone not wanting to part with a loved one. Or something like that. You can't just bury your spouse on your land even if it is the nicest land in the world. So they don't really want to punish people to harshly for something like that. A bit different, I would say than this case.

Second his wife died of cancer and he took it rough. He doted on her as she pasted but then hit the bottle hard. SO!! Okay we all have tragedy in our past. First we don't all hit the bottle and second, how is that relevant? It sucks to lose someone but I was unaware that meant later you could do what you wanted because your heart was broken. As for the bottle part well, I like to drink and have used that as a crutch so I understand, but the whole he was drunk part doesn't fly. When sonny showed up with a body daddy was sober enough to make a plan on how to dispose of it. Did half then thought, hey I am too drunk to finish?? No. If he drank during the process as he said and probably did, drunks aren't smart! You know who is smart enough to stop, someone half sober at least. People after 2 drinks might try and drive. After 4 or 5 MOST people realize they shouldn't but then 8 - 10 in, get that liquid stupidity and think they can again. IMO at least, he realized what he was doing and did it anyway. I can get behind the argument one could make he didn't want to drive drunk and have a body with him, in case he was pulled over. That is valid but if he was that drunk as he claims, I am guessing valid points weren't in his head.

The judge agrees all he did, he did to protect his son. Fine, I can't argue that point. I don't know what I could / would do to help my family, I believe though I would draw the line at murder. Every parent I know has said they would do ANYTHING for their child, I haven't actually asked would you cover up a murder? Not just the murder but mutilate a body? I would hope the answer would be no. "Hey I will take you to the cops and be there with you, you screwed up." hopefully something like that. Or even the much shittier "Lets think of a lie, say it was self defense." There is a line between protecting your family which I think almost anyone would do and being an accessory to murder. At this point I don't think protecting ones family is a valid argument anymore, 

He was a good guy, or so lots of glowing references said about him. Okay and? John Wayne Gacy was a clown at children's parties. BTK was a boy scout leader and active member of his church. Escobar built houses for the needy. Everyone has the capacity to be a good person. That hardly makes what they did less awful! One thing I do agree with, he likely isn't a danger to his community. 69 years old, no criminal record and yes he did it to help his family but again he fucking chopped up a person. Whether or not he is normally a good guy, or whether he is still a danger to the community doesn't really matter, you do the crime you should have to pay for it and not by chilling at home.

Mitigating and aggravating factors also come into play. He did help the police locate the body... WOW, what a great guy! He fucking put her there!!! On top of that he didn't do it out of the goodness of his heart. He did it because a net was closing in on him. Yes he did help convict his son for the murder, he could have done that from the get go, rather than do what he did. I don't really think we should be giving leniency because he did help in the end to save his own skin. I don't think we need to get into aggravating factors. That he hide the body or that he lied, we all know he did that. Also he didn't commit the "actual" murder. That's true, that's why I am not saying lock him away for a life sentence. He still tried to cover up a murder, I am no lawyer and not getting into it but I am not sure why they didn't try to have another charge or two on him that possibly had a stiffer sentence. At the end of the day, take away he is an old man without a criminal record, take away glowing reviews by friends and family and the case is a guy who chopped up a body. Tried to hide a murder and ONLY did anything after the police were on his trail. Does he deserve 25 years no. The victims family and friends may not agree with it but that is the criminal code that we need to abide by. Should he be rewarded with house arrest? No. This is a prime example of justice system failing. Judges are supposed to look at parity, or cases similar for sentencing. Well now they can look at chopping up a body and saying house arrest is good enough!

Anyways sorry if that was hard to read, didn't do a ton of editing just some typing while I ate my lunch. I will be back on my regular shit soon, I hope. The last thing I was gonna say is this guy gets house arrest, for chopping a body up. The liberal party and a lot of clueless supporters want C63 to pass, online harms. First glance a great bill, reading deeper bad idea. If I post something "Hateful" I could do more time than a guy who chopped up a body. Could some of my blog be hateful? Just for writing, could I spend more time in jail than this guy???

Last, last thing, for real. To the Oberly family I am sorry or any of Treasa's friends who may read this. Sorry this happened and sorry if certain times, I was graphic or seemed to not be caring in discussing her. This was a terrible crime and it is a big let down what happened. Trying to make a point, that seems to be glossed over. How horrifying this really was. Treasa Oberly was a mother, who did not deserve this.

Ahh that lovely time every few years when we see the worst in all people is upon us! That's right elections are coming! The brutal truth is both federally and provincially we are going to see shit get nasty. From both sides, let's not pretend anyone is innocent. Part 3 Addiction

So, I have stated first, we need the correct systems in place, and second, we need healthy citizens for a better society. One of the root problems in society, though, is addiction. A mental health problem that can lead to so much more. Family violence, crime, homelessness, job loss, and on and on. There is no cure for addiction. There is management, and there are many things we can do much better to help addicts and society. So, let's tackle this one next.  I like drinking! I like the taste of a good whiskey or red wine.
